EXTERIOR & INTERIOR PAINTING TERMS & CONDITIONS

(Compliant with South African Law)​

These Terms and Conditions apply to all painting services provided by PAINTPROJEX (“the Contractor”) to the Client.

By paying the required deposit, the Client is deemed to have read, understood, and accepted these Terms and Conditions in full.

1. Scope of Work

1.1 The Contractor will provide exterior and/or interior painting services as specified in the quotation accepted by the Client.

1.2 Any additional work not included in the quotation shall be treated as a variation order and will be quoted and charged separately.

2. Other Contractors and Renovations

2.1 The Contractor must be the final contractor on-site. All other renovations (including tiling, plastering, bricklaying, other painting, drilling, or grinding) must be completed before painting commences.

2.2 If ongoing renovations create dust, debris, or disruptions that affect the Contractor’s work, the Contractor reserves the right to suspend operations until conditions are suitable.

2.3 The Contractor shall not be held responsible for the actions or workmanship of other contractors, whether referred by the Contractor or not.

3. Security Estate Access

3.1 Where the project is in a security estate, the Client must complete and submit all access forms required by the estate.

3.2 Any delays or fees arising from access requirements are for the Client’s account.

4. Paint Colours and Colour Scheme

4.1 All paint colours must be finalised and signed off by the Client before work begins.

4.2 Changes to paint colours after commencement will result in additional costs and possible delays.

4.3 The Client must confirm colour choice in writing via email or WhatsApp, clearly stating the brand, colour name, and colour code. A photo of the swatch showing the name and code is acceptable.

5. Fixtures and Fittings

5.1 The Contractor may remove fixtures or fittings (e.g., blinds, doors, curtain rails) to prepare surfaces for painting. These will be reinstalled to the best of the Contractor’s ability.

5.2 The Contractor will not be liable for any damage or defects caused by removal or reinstallation.

6. Areas to Be Painted

6.1 Only visible surfaces will be painted, unless otherwise agreed in writing.

6.2 Cupboard and cabinet interiors are excluded unless specifically requested at an additional cost.

7. New Fixtures, Fittings, or Hardware

7.1 Where the Client chooses to replace existing fixtures or fittings, reinstallation may be done at no extra cost.

7.2 Where installation requires drilling, marking, or significant labour beyond the original scope, extra costs will apply as a variation order.

7.3 Extra charges may apply if Client-supplied hardware or fittings are faulty or incompatible. At the Client’s request, the Contractor may supply and fit suitable alternatives at an additional cost.

8. Paint Curing Time

8.1 Painted surfaces may feel dry to the touch, but require a curing period of approximately 14 days to reach full hardness and durability.

8.2 During this period, surfaces must not be subjected to knocks, scrapes, abrasive cleaning, or chemical products.

9. Weather Conditions

9.1 Cold or damp weather may negatively affect paint adhesion and drying times.

9.2 The Contractor may postpone work if weather conditions could compromise quality.

10. Clearing of Rooms (Interior Projects)

10.1 The Client must remove valuables and personal items from all rooms to be painted.

10.2 The Contractor’s staff will move or cover large furniture where necessary but will not be held responsible for damage to any items or surfaces.

10.3 Additional costs may apply if excessive time or labour is required to clear areas not prepared by the Client.

11. Guarantees and Materials

11.1 The Contractor does not provide warranties on third-party materials (paint, primers, sealers).

11.2 Any product defects must be pursued directly with the manufacturer.

12. Workmanship Warranty

12.1 The Contractor warrants workmanship for 90 days from completion.

12.2 The Contractor may, at its discretion, repair or rectify defects reported in writing during this period.

12.3 This warranty excludes material defects and any consequential costs.

13. Inspection and Touch-Ups

13.1 The Client must perform a final inspection within 48 hours of completion.

13.2 Defects must be reported in writing within 7 days.

13.3 Failure to report within this period may result in additional call-out fees for remedial work.

13.4 Once identified issues are remedied, the project will be deemed complete and closed.

14. Payments

14.1 A deposit of 75% of the total project cost is required at least 5 days before commencement of work.

14.2 The remaining 25% is payable upon completion of the project, which includes the final coat of paint and reinstallation of fixtures/fittings.

14.3 No work will commence until the deposit has cleared.

15. Work Area, Ablutions, and Storage

15.1 The Client must provide ablution facilities, a covered work area, and secure storage for tools and materials.

16. Cash Payments

16.1 A 5% surcharge applies to cash payments to cover banking deposit fees.

17. Cancellations

17.1 If the Client cancels after paying the deposit but before work commences, 50% of the total project cost will be retained.

17.2 If the Client cancels after work has commenced, the full deposit (75%) will be forfeited.

18. Acceptance of Terms

18.1 Payment of the deposit constitutes full acceptance of these Terms and Conditions.

18.2 This clause is binding and enforceable under South African contract law and the Consumer Protection Act (where applicable).

19. Governing Law

19.1 These Terms and Conditions are governed by the laws of the Republic of South Africa.

 

KITCHEN & BATHROOM REFINISHING TERMS & CONDITIONS​

(Compliant with South African Law)
 

These Terms and Conditions (“Agreement”) govern all services rendered by PAINTPROJEX (“the Contractor”) to the Client (“the Client”) in respect of kitchen and/or bathroom refinishing projects.

By paying the deposit as stipulated in Clause 13, the Client is deemed to have read, understood, and agreed to these Terms and Conditions in full.

1. Consultation Fee

A non-refundable consultation fee of R600 is payable prior to the scheduled consultation. This fee covers an initial colour consultation and scope of work assessment.

Should the Client accept the quotation and proceed with the project, the consultation fee will be credited against the final project cost.

If the Client cancels or reschedules a consultation with less than 24 hours’ notice, the Contractor reserves the right to retain 50% of the consultation fee.

2. Other Contractors / Renovations

The Contractor must be the final contractor on-site. All tiling, plastering, bricklaying, other painting, or dust-generating activities must be completed prior to commencement.

The Contractor is not responsible for the workmanship or actions of other contractors, even if referred by the Contractor.

3. Security Estate Access

The Client must arrange all access permits and security estate forms prior to commencement.

Any access fees charged will be for the Client’s account and added to the final invoice.

4. Paint Colours and Schemes

All paint colours must be finalised and signed off prior to commencement.

The Client must confirm their colour choice in writing, either via email or WhatsApp message. The confirmation must include the brand name, colour name, and colour code. A photo of the swatch showing the name and code is also acceptable.

Any colour changes during the project will incur additional costs and possible delays.

5. Cabinet Doors and Drawers

The Contractor will detach cabinet doors and drawers for preparation and painting, either on-site or off-site.

Only visible areas will be painted unless otherwise agreed at additional cost.

Realignment of old hinges and runners is attempted but not guaranteed.

6. Handles, Hinges, and Hardware

Replacing handles requiring drilling or filling incurs extra costs.

Replacement of defective hinges or runners is at the Client’s expense.

Extra charges may be incurred if Client-supplied hardware is faulty or incompatible. At the Client’s request, the Contractor may purchase and fit suitable hardware at additional cost.

7. Paint Curing Time

Paint requires at least 2 weeks to fully cure. During this time, the Client must avoid harsh cleaning, abrasives, or impacts.

8. Weather Conditions

Cold or damp weather may delay work. The Contractor may pause work if conditions compromise quality.

9. Clearing of Kitchen Cupboards

Cupboards must be cleared by the Client before work begins. The Contractor accepts no responsibility for breakages or tainting of foodstuffs if required to clear cupboards.

10. Guarantees

The Contractor does not warrant manufacturer defects in materials. Any such claims must be taken up directly with the manufacturer.

11. Workmanship Warranty

Defective workmanship reported in writing within 7 days of completion will be rectified at the Contractor’s discretion.

No liability is accepted for consequential costs.

12. Inspection and Touch-Ups

The Client must perform inspection within 48 hours post-completion and report defects in writing within 7 days.

Failure to do so may result in additional charges for rectification.

13. Payments and Binding Agreement

A deposit of 75% of the project price is payable at least 4 days before commencement.

The balance of 25% is payable after the second coat of paint but before final coat of paint and reattachment of doors/drawers.

Upon payment of the deposit, the Client acknowledges that they have read, understood, and agree to these Terms and Conditions in full. This acknowledgment is legally binding even if no physical signature is provided.

14. Work Area, Ablutions, and Storage

The Client must provide staff ablutions, a covered work area, and a secure tool storage area.

15. Cash Payments

Cash payments attract a 5% surcharge due to bank deposit fees.

16. Cancellations

If cancelled after deposit payment but before commencement, 50% of project cost is retained.

If cancelled after work has commenced, no refunds will be made.

17. Furniture, Flooring, and Appliance Protection

While precautions will be taken, the Contractor is not liable for dust ingress or minor paint transfer. Major negligence will be covered by the Contractor.

18. Hidden Defects

The Contractor is not responsible for hidden defects (e.g., water damage, rot, mould) discovered during work. Additional repairs may be quoted separately.

19. Electrical and Plumbing Work

The Contractor does not perform plumbing or electrical modifications. Any such work must be arranged by the Client.

20. Waste Disposal

The Contractor will remove paint-related waste but not general building rubble or household waste.

21. Health and Safety

The Client must ensure a safe working environment. Children and pets must be kept clear of the work area.

22. Insurance

The Contractor carries public liability insurance. Clients are advised to maintain their own household insurance.

23. Force Majeure

The Contractor is not liable for delays or damages caused by events beyond reasonable control, including strikes, natural disasters, or supplier failures.

24. Limitation of Liability

The Contractor’s liability is strictly limited to the value of the contract. Indirect or consequential losses are excluded.

25. Entire Agreement

This document constitutes the entire agreement between the Contractor and Client.

By paying the deposit, the Client confirms acceptance of these Terms and Conditions.

INSTRUCTIONS FOR CARING FOR YOUR NEWLY PAINTED KITCHEN

Proper care after painting your kitchen can help preserve the finish and maintain a fresh, clean look. Here are step-by-step instructions to care for your newly painted kitchen:

 

1. **Allow Paint to Cure**

Drying Time:** While the paint may feel dry to the touch after 24 hours, it can take up to 2 weeks for the paint to fully cure.

Avoid Heavy Cleaning:** During the first 2 weeks, avoid any heavy scrubbing or use of harsh cleaners on the cabinets/tile surfaces.

 

2. **Ventilation is Key**

Leave the Doors & Drawers slightly open.**  For the first 2 days after completion of the project to avoid that the surfaces stick to each other while the paint fully dries.

Keep Air Flowing:** Ensure proper ventilation in the kitchen by opening windows.

Control Moisture:** Kitchens are prone to moisture, so make sure to reduce humidity levels by using a dehumidifier if necessary.

 

Mild Detergents:** Use a mild, non-abrasive cleaner (like dish soap diluted with water) to gently wipe down any grease, food splatters, or dirt.

Avoid Scrubbing:** Do not use abrasive sponges, brushes, or harsh chemicals, as they can damage the paint surface.

 

4. **Spot Cleaning**

Immediate Cleanup:** For spills or grease splatters, it’s best to clean them immediately with a damp

Stubborn Spots:** For tougher stains, try a mixture of warm water and a small amount of baking soda. Apply it gently with a soft cloth, then rinse with clean water and dry the area.

 

5. **Preventing Damage**

- **Avoid Sharp Objects:** Be mindful of sharp kitchen tools or items that could scratch or chip the walls.

 

6. **Regular Dusting**

Keep Dust-Free:** Regularly dust the painted surfaces with a feather duster or a dry microfiber cloth to prevent buildup.

 

7. **Periodic Repainting**

Touch-ups:** Over time, minor touch-ups might be needed to maintain a fresh look. Please contact us and we will do any touch-ups or refresher coats at a nominal charge.

 

By following these steps, you can keep your newly painted kitchen looking vibrant and clean for years to come.
